Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Dispatch website and platform (the “Service”), operated by SSI Labs Ltd. (“SSI Labs,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Use of the Service

You may use the Service only in compliance with these Terms and all applicable laws. You are responsible for the activity that occurs under your account and for keeping your account credentials secure.

2. Accounts

Some features require an account. You agree to provide accurate and complete information and to keep it up to date. We may suspend or terminate accounts that violate these Terms.

3. Customer Data

You retain all rights to the data you submit to the Service (“Customer Data”). You grant us a limited licence to host, process, and transmit Customer Data solely to provide and improve the Service. Our handling of personal information is described in our Privacy Policy.

4. Fees

Paid plans are billed in advance and are non-refundable except where required by law. We will give reasonable notice before changing pricing that affects your plan.

5. Acceptable Use

• Do not misuse, disrupt, or attempt to gain unauthorized access to the Service.
• Do not use the Service to store or transmit unlawful or infringing content.
• Do not reverse engineer or resell the Service without our written consent.

6. Messages You Send Through the Service

If you use the Service to send text messages or emails to your clients or crew, you are responsible for having their consent and for following applicable law, including Canada’s Anti-Spam Legislation (CASL) and, for recipients in the United States, the Telephone Consumer Protection Act and carrier rules. You must honour opt-out requests, keep your business name, contact details, and privacy policy link accurate in your account settings, and not use the Service to send marketing texts or unlawful content. We may suspend messaging for accounts that misuse it.

7. Text Message Terms

These terms apply to anyone who receives text messages sent through Dispatch, including clients and crew of businesses that use the Service.

• Program: businesses that use Dispatch send appointment confirmations, reminders, and job updates to their clients, and job assignments and schedule changes to their crew. Messages identify the business that sent them.
• Consent: you receive client texts only after agreeing to them, for example by ticking an optional box on a request form. Consent is not a condition of any purchase.
• Frequency: message frequency varies.
• Cost: message and data rates may apply.
• Opt out: reply STOP to any message to stop receiving texts. You will receive one final message confirming the opt-out.
• Help: reply HELP to any message, or email [email protected].
• Carriers: mobile carriers are not liable for delayed or undelivered messages.
• Privacy: see our Privacy Policy. We do not share mobile numbers or opt-in data with third parties for their marketing.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by SSI Labs and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or other brand features.

9. Disclaimers

The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, SSI Labs will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by other reasonable means. Continued use after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there.
